OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. MUST BE PRESENT AT THE TIME OF DRAWING TO WIN.

The "Hoochenanny Hot Tub Giveaway" Sweepstakes ("Sweepstakes") begins at 4:00 PM ET on August 14, 2026, and ends at approximately 7:00 PM ET on August 16, 2026 ("Sweepstakes Period").

The Sweepstakes is sponsored by But Wait, There’s More!, LLC ("Sponsor"), 80 Sovran Drive, Webster, NY 14580. The Sweepstakes is administered in conjunction with Design Pool & Spa LTD ("DPS"), 7244 Pittsford Palmyra Road, Fairport, NY 14450, which will manage Sweepstakes entries and prize fulfillment, including hot tub selection, upgrades, delivery, and applicable site requirements.

By entering, participants agree to these Official Rules and the decisions of Sponsor and DPS regarding the Sweepstakes, which are final.

ELIGIBILITY

Open to legal U.S. residents age 18 or older as of August 14, 2026. Employees, owners, officers, directors, agents, and affiliates of Sponsor or DPS, their immediate family members (parents, children, siblings, and spouses), and members of their households are not eligible.

The Sweepstakes is conducted at the Hoochenanny Festival in Fairport, NY. All federal, state, and local laws apply. Void where prohibited.

HOW TO ENTER

Visit the designated giveaway booth at the Hoochenanny Festival during the Sweepstakes Period and complete the official registration form with the requested contact information.

Limit one entry per person. Entries must be complete and received before the drawing. Incomplete, inaccurate, illegible, duplicate, late, lost, or misdirected entries may be disqualified. Sponsor and DPS are not responsible for technical difficulties preventing submission.

All entries and entrant information collected through the Sweepstakes will be owned and maintained by Design Pool & Spa LTD. By entering, participants consent to DPS using their information to administer the Sweepstakes and, where permitted, for future DPS marketing and promotional communications.

PRIZE

One (1) Grand Prize will be awarded.

The verified winner will receive their choice of one (1) qualifying Hydropool Serenity 6610 or Hydropool Serenity 4510 hot tub, subject to inventory and manufacturer availability. Color, cabinet finish, options, and other specifications are subject to availability.

The Prize is non-transferable, non-refundable, and has no cash redemption value. No cash, store credit, refund, or other payment will be provided in place of the Prize.

DPS may substitute a prize of comparable or greater value if necessary due to availability or circumstances outside its reasonable control. The Prize is provided "as is" and is subject to applicable manufacturer's warranties. Sponsor and DPS make no additional warranties or guarantees.

Any applicable tax requirements or tax-related information associated with the prize will be communicated to the winner directly by But Wait, There’s More!, LLC.

UPGRADE OPTION

The winner may upgrade to another qualifying hot tub offered by DPS by paying the full difference between the awarded Prize and the upgraded hot tub, plus any additional options, accessories, taxes, delivery charges, or other applicable costs.

Upgrades are subject to availability and DPS approval. No cash, credit, or refund will be given if the winner selects an option of lesser value.

SELECTION & DELIVERY DEADLINE

The winner must select their hot tub and complete delivery within sixty (60) days of being declared the official winner.

The winner is responsible for completing all site preparation and cooperating with DPS to schedule delivery within this period. Failure to select the hot tub, prepare the site, cooperate in scheduling, or complete delivery within 60 days may result in forfeiture of the Prize at DPS's discretion.

Selecting an upgraded hot tub does not extend the deadline. DPS may make a reasonable extension if a delay is caused solely by DPS or manufacturer availability.

DELIVERY & SITE REQUIREMENTS

Free standard delivery is included within 30 miles of Design Pool & Spa LTD, 7244 Pittsford Palmyra Road, Fairport, NY 14450.

Delivery over 30 miles and up to 50 miles is available for an additional fee determined by DPS and paid by the winner. DPS delivery is not available beyond 50 miles. DPS will determine distance and delivery eligibility.

Before delivery, the winner must provide:

• A clear, unobstructed delivery path with a minimum of 40 inches of clearance throughout the entire route.
• A level, structurally adequate support pad or foundation suitable for the filled and occupied hot tub.
• All required electrical service and hookups. DPS does not perform electrical work as part of the Prize. Electrical work must be completed by a qualified electrician and comply with applicable codes and permit requirements.
• An adult age 18 or older present at the time of delivery to provide access and approve final placement.
• A final location that provides reasonable access to the equipment and plumbing for future service and maintenance.
• Compliance with applicable building codes, zoning, setbacks, permits, HOA requirements, electrical codes, and other regulations.

DPS may postpone or refuse delivery if the route, site, foundation, or other conditions are unsafe or unsuitable. Site-related delays do not automatically extend the 60-day deadline.

The winner is responsible for all site-preparation costs, including any necessary modification or removal of gates, fences, landscaping, railings, structures, or other obstructions; pad/foundation work; electrical work; permits; or specialty delivery requirements.

Crane service and other specialized delivery equipment are not included and, if required, are the winner's responsibility.

DRAWING & WINNER NOTIFICATION

One (1) potential winner will be randomly selected from all eligible entries at approximately 7:00 PM ET on August 16, 2026, at the Hoochenanny Festival.

Odds of winning depend on the number of eligible entries received.

Winner must be present to win. The selected entrant will have 10 minutes after their name is announced to report to the designated giveaway booth. Failure to do so will result in forfeiture, and another potential winner may be drawn. This process may continue until an eligible winner is confirmed.

The determination of the winner is final.

WINNER REQUIREMENTS

The winner may be required to provide valid identification and sign an Affidavit of Eligibility, Liability/Publicity Release, Prize Acceptance Agreement, delivery acknowledgment, and/or these Official Rules. Failure to complete required documentation within the established timeframe may result in forfeiture.

Except where prohibited by law, acceptance of the Prize grants Sponsor and DPS permission to use the winner's name, photograph, likeness, voice, statements, and city/state for advertising, promotional, website, and social media purposes without additional compensation. The winner agrees to reasonably cooperate with photos and/or video related to the Prize presentation or delivery.

GENERAL TERMS & LIABILITY

By entering, participants agree to release, discharge, indemnify, and hold harmless But Wait, There’s More!, LLC, Design Pool & Spa LTD, and their respective owners, employees, officers, agents, affiliates, promotion partners, contractors, and representatives from liability, loss, damage, claim, expense, injury, or property damage arising from participation in the Sweepstakes or acceptance, delivery, installation, possession, use, or misuse of the Prize, except where prohibited by law.

The winner is responsible for proper installation, electrical connection, maintenance, and operation of the hot tub according to manufacturer instructions and applicable laws and codes. Sponsor and DPS are not responsible for third-party electrical work, site preparation, or property modifications.

Sponsor and DPS may disqualify anyone who violates these Rules, submits multiple entries, provides false information, interferes with the Sweepstakes, or acts fraudulently. Sponsor reserves the right to modify, suspend, or cancel the Sweepstakes if circumstances beyond its reasonable control affect its fairness, security, integrity, or administration, subject to applicable law.

DISPUTES

Any dispute or claim relating to the Sweepstakes or Prize will be resolved individually and not as part of a class action. To the extent permitted by law, recovery is limited to actual out-of-pocket costs associated with entering the Sweepstakes and excludes attorneys' fees and punitive, incidental, consequential, or multiplied damages.

These Official Rules are governed by New York law. Any legal proceeding arising from the Sweepstakes shall be brought in a court of competent jurisdiction in New York. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
